The Little Rock District (“District”) of the United States Corps of Engineers (“Corps”) issued a public notice on January 14th announcing the final rule that revised and renewed certain nationwide permits (“NWPs”) under Section 404 of the Clean Water Act.

Besides identifying the 16 NWPs that will go into effect on March 15th and referencing the status of the 40 existing NWPs, the District noted:
- Corps divisions will begin finalizing regional conditions for the 16 NWPs
- Corps divisions and districts will begin determining which conditions for water quality certifications issued by states, tribes, and the United States Environmental Protection Agency for issuance of these NWPs become conditions of the NWPs
- Corps divisions and districts will begin determining which conditions for Coastal Zone Management Act consistency concurrences issued by states for the issuance of the NWPs become conditions of the NWPs
- The regional conditions for the 40 NWPs that were approved by division engineers in 2017 remain in effect
