Senator Sanders introduced Senate Bill (“SB”) 364 which would revise certain Arkansas statutory notice requirements related to particular permits issued by the Arkansas Department of Environmental Quality (“ADEQ”).
The process for issuing permits by ADEQ requires certain public notices that are driven by either federal and/or Arkansas law.
The bill revises certain sections of Ark. Code. Ann. § 8-4-203.
The purpose of SB 364 is stated to include:
- Simplify and modernize the notice requirements for permits issued by ADEQ
- Allow electronic notice of permitting decisions on ADEQ’s website when allowed by federal law
It is my understanding that SB 364 was drafted and proposed for submission by ADEQ.
The bill has been referred to the Senate Committee on Public Health, Welfare and Labor.
