Representative Davis introduced House Bill (H.B.) 1505 whose stated purpose is to:
- Clarify the definition of an National Ambient Air Quality Standard (“NAAQS”) State Implementation Plan (“SIP”)
- Clarify the requirement for written explanations in support of NAAQS
SIP and NAAQS are terms utilized by the federal Clean Air Act.
The Clean Air Act requires that the United States Environmental Protection Agency (“EPA”) identify pursuant to Section 108 air pollutants for which nationwide ambient standards should be established. NAAQS are then established for the air pollutant.
Once an NAAQS is established the states are primarily responsible for ensuring its attainment and maintenance. Each state is therefore required to formulate, subject to EPA approval, a State Implementation Plan (“SIP”).
H.B. 1505 amends certain sections of the Arkansas Water and Air Pollution Control Act that addresses these Clean Air Act provisions/requirements.
The bill has been referred to the House Public Health, Welfare and Labor Committee.
