The 93rd Arkansas General Assembly convened for regular session on January 11th.
The pre-filing of bills and resolutions began on November 16th.
Senate Bill 137 (“SB 137”) has been filed whose purpose is stated to:
. . . prohibit discrimination on the basis of the energy source of a utility service.
SB 137 is sponsored by Senator Irvin and Representative Pilkington.
Arkansas Code Title 14, Chapter 1, Subchapter 1 would be amended to include a section that would prohibit local governments from enacting or adopting:
. . . any ordinance, policy, or action that infringes, prohibits, or otherwise impairs the right of a customer to purchase, use, connect, or reconnect to a utility service, or to install in a building or other structure wires, pipes, or other conduits for the purpose of purchasing, using, connecting, or reconnecting to a utility service, on the basis of the energy source of the utility service to be delivered to the customer.
