The 93rd Arkansas General Assembly will convene for regular session on January 11, 2020.
The pre-filing of bills and resolutions began on November 16th.
Senate bill 65 was filed on January 7th. It would amend certain provisions of the Arkansas Code addressing state emission plans for fossil-fuel-fired electric generating units.
The legislation would amend and/or repeal certain provisions of Subchapter 2 (State Emission Plans – Procedures – Approval) of Chapter 3 (Water and Air Pollution Generally) of Title 8 of the Arkansas Code. See Ark. Code Ann. 8-3-201 et seq.
The Subchapter provisions that would be amended include:
- Ark. Code Ann. § 8-3-205(a) (addressing assessment of the effects of the state plan for regulating carbon dioxide emissions from covered electric generating units)
- Ark. Code Ann. § 8-3-207(a) (addressing procedures for approval of the state plan)
- Ark. Code Ann. § 8-3-207(d) (addressing the Governor’s submission of a state plan to the United States Environmental Protection Agency)
- Ark. Code Ann. § 8-3-208 (significant increase in the total electric or natural gas bill annually for any customer class)
The legislation would repeal Ark. Code Ann. § 8-3-209 (waiver of review and approval procedures for emission plans).
