The Arkansas Department of Energy & Environment - Division of Environmental Quality ("DEQ") and H.G. Toler & Son Lumber Company, Inc. ("HG") entered into a January 30th Consent Administrative Order ("CAO") addressing an alleged violation of an air permit. See LIS No. 24-020.
HG is stated to own and operate a lumbermill ("Facility") in Grant County, Arkansas.
The Facility is stated to operate pursuant to an air permit.
ADEQ personnel are stated to have conducted a compliance inspection of the Facility on February 28, 2023. The inspection is stated to have covered the reporting period of July 1, 2021, through January 31, 2023.
HG is stated to have installed and operated an unpermitted diesel emergency generator, violating General Provision 23 of Permits R8 and R9.
HG submitted a response to a DEQ query on May 2, 2023, indicating that the Facility would submit a minor permit modification application to DEQ to include the diesel emergency generator. A permit modification application was submitted to DEQ on October 23, 2023, to add the unpermitted diesel emergency generator to the permit. A draft permit was subsequently issued by DEQ.
HG neither admits nor denies the factual and legal allegations contained in the CAO.
A civil penalty of $960 is assessed.
