The Mississippi Commission on Environmental Quality (“MCEQ”) and Tronox, LLC (“Tronox”) entered into a July 19th Agreed Order (“AO”) addressing an alleged violation of an air permit. See Order No. 7203 22.
Tronox operates a manufacturing facility (“Facility”) in Hamilton, Mississippi.
The AO references the Facility’s utilization of a Clean Air Act Title V Operating Permit. See Permit No. 1840-00035.
The Tronox Facility is stated to have emitted 18.22 pounds per hour of Particulate Matter (“PM”) from Emission point 202 during a stack test on July 28, 2020. This is stated to have exceeded the PM limit of 10.0 lb/hr in Section 3.B. of the Title V Operating Permit.
The Facility is stated to have conducted a successful retest of Emission 202 on August 29, 2020. During such stack test the Facility is stated to have emitted 4.92 lb/hr of PM.
The AO assesses a civil penalty of $65,000.
