The Missouri Department of Natural Resources (“MDNR”) and Maxion Wheels Sedalia LLC (“MWS”) entered into a November 11th Administrative Order on Consent (“AOC”) addressing an alleged violation of an Air Operating Permit. See No. APCP-2024-034.
The AOC provides that MWS owns and operates an automotive wheel manufacturing and finishing company in Pettis County, Missouri.
The facility is stated to operate pursuant to an Intermediate Operating Permit.
This permit states that an installation’s right to operate shall terminate upon the expiration of the permit, unless a complete permit renewal application is submitted at least six months before the date of the expiration, or unless the permit authority takes final action approval an application for a permit renewal by the expiration date.
The facility’s Intermediate Operating Permit is stated to have expired on November 13, 2020. Therefore, the facility is required to submit a complete renewal application by May 13, 2020. MDNR did not receive a complete renewal application under October 30, 2020.
The AOC requires that MWS cooperate with MDNR’s Air Pollution Control Program’s Permitting Section for the timely issuance of a new operating permit. Further, the facility must continue to operate under the Intermediate Operating Permit, subject to all permit conditions and requirements, until the new operating permit is issued.
