The Missouri Department of Natural Resources (“MDNR”) and Purcell Tire & Rubber Company (“Purcell”) entered into an October 22nd Administrative Order on Consent (“AOC”) addressing an alleged violation of the Missouri Air Regulations. See No. APCP-2023-038,
The AOC provides that Purcell owns and operates a tire processing installation in Washington County, Missouri.
The facility is stated to operate subject to Missouri Air Conservation Regulation 10 CSR 10-6-065 addressing Operating Permits and Intermediate Operating Permit. These provisions are stated to require the submission of a complete application for renewal of the Operating Permit at least 6 months before the date of expiration.
Purcell’s Intermediate Operating Permit is stated to have expired on July 1, 2023, and the renewal application was due on January 31, 2023. The AOC alleges that Purcell failed to submit a renewal application by January 31, 2023.
Purcell submitted a permit renewal application which was deemed complete on April 11, 2023. Such permit application is currently being evaluated by the MDNR Air Pollution Control Programs Permit Section.
The alleged failure to submit a complete operating permit renewal application at least six months prior to the permit expiration is deemed a violation of 10 CSR 10-6.065.
A civil penalty of $3,750.00 is assessed. Further, Purcell agrees to continue to operate under the authority of its Intermediate Operating Permit subject to all permit conditions and requirements until the renewal permit is issued.
