The Tennessee Air Pollution Control Board (“Board”) issued a proposed May 28th Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to Institutional Case Work, Incorporated (“ICI”). See Division of Air Pollution Control Case No. APC 20-0016.
The Order provides that ICI operates a furniture manufacturing operation (“Facility”) in Paris, Tennessee.
The Facility is stated to have been issued a Title V Operating Permit (“Permit”) on June 1, 2015. The expiration date of the Permit is stated to be May 31, 2020.
Condition A-12 of the Permit addresses expiration and requirements for the permit’s renewal. The Division of Air Pollution Control (“Division”) is stated to have received ICI’s permit renewal on December 4, 2019.
The Order states that based on the expiration date and Condition A-12 of the Permit that ICI’s Title V Permit Renewal Application was required to be submitted to the Division between September 24, 2019 and December 3, 2019.
A Notice of Violation was issued by the Division to ICI for failing to submit a timely and complete Title V Permit Renewal Application at least 180 days, but, not more than 270 days prior to the Permit’s expiration date.
The Order requires that ICI adhere to all conditions of the Permit, except Condition A-12. Further, it assesses a civil penalty of $1,500.00.
The Order provides certain appeal rights to ICI.
