The Tennessee Air Pollution Control Board (“Board”) issued a February 28th Proposed Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to Clear Development, LLC (“CD”) alleging violations of an air permit. See Case No. APC25-0023.
The Order states that CD operates a rock crushing and sizing operation in Grainger County, Tennessee.
The Technical Secretary is stated to have issued a True Minor Combined Construction – Operating Permit to CD for a rock crushing and sizing operation on September 14, 2021.
Tennessee Division of Air Pollution Control personnel are stated to have conducted an inspection at the facility on June 26, 2024. Division personnel are stated to have determined during a review of the facility’s records that it had not submitted a Startup Certification required by the Permit. Further, the Order provides that the facility started production on October 21, 2021, but based on Condition 7 of the Permit Startup Certification should have been submitted by November 20, 2021. This is stated to have been submitted 1,145 days late.
An inspection was conducted by Division of Air Pollution Control personnel at the facility in review of its production records on June 26, 2024. The review is stated to have indicated that the facility did not have production records for the period of October 21, 2021 through November 2, 2023.
The Order proposes the assessment of a penalty of $3,000.00. Certain appeal rights are provided.
