The Tennessee Air Pollution Control Board (“Board”) issued a February 15th proposed Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to Hickory Valley Gin Company (“Hickory Valley”) addressing alleged violations of an air permit. See Case No. APC20-0128.
The Order addresses a cotton gin owned by Hickory Valley located in Hickory Valley, Tennessee.
The Technical Secretary issued an operating permit to the cotton gin on September 4, 2012.
The Division of Air Pollution Control (“Division”) is stated to have received Hickory Valley’s Annual Report of Bales Processed (“Report”) on October 9, 2020. The Report addressed the 2019 ginning season.
The Order states that the Report was submitted to the Division approximately 192 days late. Further, it is stated to have indicated that 8,778 bales were processed by the Hickory Valley Cotton Gin during the 2019 ginning season. Condition 4 of the cotton gin’s air permit states that the number of bales processed during a ginning season shall not exceed 8,700.
The Order proposes to assess a civil penalty of $2,250. Certain appeal rights are provided by the Order.
