The Technical Secretary of the Tennessee Air Pollution Control Board (“Board”) issued a May 1st Order and Assessment of Civil Penalty (“Order”) to Florim USA, Inc. (“Florim”) for alleged violation of an air permit. See Case No. APC16-0200.
The Order states that Florim operates a ceramic tile manufacturing facility in Clarksville, Tennessee (“Facility”).
A Major Source Operating (Title V) permit is stated to have been issued to Florim on September 20, 2010. It has been subject to subsequent modifications.
Condition E6-1 of the permit states in pertinent part:
Particulate matter (PM) emitted from this source . . . shall not exceed 1.2 pounds per hour . . . Compliance with this emission limitation shall be assured by maintaining a minimum pressure drop of 1.8 inches of water across the baghouse.
The Order states that on November 29, 2016 the Tennessee Air Pollution Control Division (“Division”) received the facility’s Semi-Annual Report for the reporting period of April 1, 2016, through September 30, 2016, and the Annual Certification of Compliance for the reporting period of October 1, 2015 through September 30, 2016. It is alleged that the reports document that Florim failed to maintain the minimum pressure drop of 1.8 inches of water on nine of the 154 days the source was in operation.
As a result, the Division was stated to have issued a Notice of Violation to Florim.
The Order proposes to assess a civil penalty of $2,250 which the company may appeal.
