The United States Department of Justice (“DOJ”) issued an August 3rd news release announcing a settlement agreement (denominated a “Consent Decree”) with Anchor Glass Container Corporation (“Anchor”) addressing alleged Clean Air Act violations.
DOJ states that the settlement agreement will resolve Clean Air Act violations at six Anchor glass manufacturing facilities located in Florida, Georgia, Indiana, Minnesota, New York and Oklahoma.
The settlement agreement (which must be approved by the United States District Court) requires that Anchor install pollution controls to cut emissions of nitrogen oxide, sulfur dioxide, and particulate matter at its container glass manufacturing facilities.
The alleged violations addressed by the settlement agreement (i.e., Consent Decree) involve the failure to seek permits for New Source Review major modifications at the container glass facilities. These facilities are stated to manufacture beer bottles, liquor bottles, other beverage bottles, jars, and other glass containers.
Besides the required pollution controls, the company is assessed a $1.1 million civil penalty.
