The Clean Air Council and Environmental Integrity Project (collectively, “CAC”) sent a February 17th Notice of Intent to Sue (“Notice”) to Shell Oil Company (“Shell”) for alleged violations of the Clean Air Act and Pennsylvania Air Pollution Control Act.
The Notice addresses Shell’s Polymers Monaca Site (“Facility”) in Beaver County, Pennsylvania.
The Notice alleges that the Facility has repeatedly violated, and is in violation of:
- Federal Clean Air Act
- Pennsylvania State Implementation Plan
- Pennsylvania Air Pollution Control Act
- Facility’s Clean Air Act Permit
The alleged violations are stated to involve the emission of air pollutants in amounts in excess of, and not authorized by, the Facility’s Air Permit.
A separate section of the Notice alleges:
- Violation of site-wide, 12-month rolling NOx emission limitation
NOx is alleged to have been emitted from the Facility in excess of its Plant Approvals. Specifically, it is alleged that the Facility emitted 310.215 tons NOx between August and December 2022 which is stated to have involved reaching the 12-month limit during the five-month period.
