The American Chemistry Council (“ACC”) issued two flow diagrams addressing programs/rules the United States Environmental Protection (“EPA”) is developing pursuant to the amendments to the Toxic Substances Control Act (“TSCA”).
TSCA addresses the production, importation, use and disposal of specific chemicals.
A key focus of the TSCA amendments was the imposition of deadlines for EPA to take action (i.e., risk evaluations must be completed within three years). Further, a new system was created for EPA to evaluate and manage risks with chemicals already in the market.
ACC has produced a flowchart called Prioritization Process Steps. (This flowchart is subtitled “EPA must first clarify criteria, methods, tools, approaches, etc. for Prioritization Process Rule.”)
The other flowchart addresses the risk evaluation framework and contains two steps:
- Step 1 – Scope/Screening
- Step 2 – Refined Risk Evaluation
ACC describes itself a diverse set of companies engaged in the business of chemistry.
