The Arkansas Oil Marketers Association (“AOMA”) issued a May 8th notice linking to disaster declarations that Governor Hutchinson has issued for 36 Arkansas counties and two cities.
These disaster declarations were issued following recent storms that caused heavy flooding throughout significant portions of the state.

The AOMA document contains a memorandum providing “Frequently Asked Questions” on Arkansas statutory restrictions addressing fuel prices in areas under an emergency/declaration.
The guidance document addresses questions such as:
- Ability to adjust fuel prices (during a State of Emergency)
- Frequency of adjustment of prices (during a State of Emergency)
- Raising prices when a price increase notice is received from a supplier
- Can prices raised to meet competition?
