The Arkansas Department of Energy & Environment – Division of Environmental Quality (“DEQ”) circulated a May 5th email reminder to Arkansas hazardous waste generators regarding the due date for remittance for Remedial Action Trust Fund Act Fees (i.e., Superfund fee).
The DEQ reminder notes that the fees are due July 1st and a chart is provided which identifies how to calculate the applicable fee.
Fees are based on the hazardous waste generator’s annual report.
The applicable regulatory authority for assessment of these fees is found in Section 6 of the Arkansas Pollution Control and Ecology Rule 23.
