Susan Speake of the Arkansas Department of Environmental Quality (“ADEQ”) undertook a presentation at the Arkansas Environmental Federation Regulated Waste Seminar titled:
Landfill Post-Closure Trust Fund Update (“Presentation”)
Ms. Speake’ s Presentation described the Landfill Post-Closure Trust Fund (“Trust Fund”) noting:
- The Trust Fund was established by Act 747 of 1991
- Amended by Act 1037 of 2015 to include closure of waste tire processing facilities or disposal sites owned or operated by Regional Solid Waste Management Districts
- Amended by Act 624 of 2017 repealing $25 million cap
- Used to perform corrective action at a site that is causing groundwater or other type of contamination
The Trust Fund’s financial support is noted to include disposal fees (collected and paid on a quarterly basis by permitted landfills, excepting private industrial landfills).

Ms. Speake serves as the Trust Fund Manager (Remediation & Assessment) in ADEQ’s Office of Land Resources.
