The Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) issued a July 8th news release noting a scheduled Regulated Storage Tank Stakeholders Meeting via teleconference.
DEQ’s Office of Land Resources will be hosting the meeting that will be held at 9:00 a.m. on July 21st.
DEQ states that items on the agenda include:
. . . draft guidance documents on upcoming implementation of Federal requirement changes taking effect on October 13, 2021, for Arkansas’s regulated Storage Tank facilities.
Federal underground storage tank (“UST”) regulations address the design, operation, installation, leak detection, closure, financial assurance, and release reporting aspects of operating this equipment. This federal program was delegated to DEQ many years ago. As a result, DEQ implements the baseline federal UST regulations. UST regulations are found in Arkansas Pollution Control and Ecology Rule 12.
The United States Environmental Protection Agency EPA undertook revisions of the federal UST regulations in 2015. As a result, delegated states (including Arkansas) were required to reapply in order to retain their program approval status. Arkansas submitted program revisions which were subsequently approved by EPA.
