Nucor-Yamato Steel Company (“NYS”) filed a March 16th Request for Commission Review and Adjudicatory Hearing (“Request”) before the Arkansas Pollution Control and Ecology Commission (“Commission”).
The Request challenges a Clean Water Act National Pollution Discharge Elimination System (“NPDES”) permit renewal for a steel mill NYS operates in Blytheville, Arkansas.
The NYS NPDES permit renewal is stated to have been issued by the Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) on February 16th.
The legal issues and factual disputes addressed in the Request include:
- Water Quality Based Mass Limits for Oil and Grease, Outfall 001 Process Wastewater
- Whole Effluent Toxicity Limits - Outfall 002 Stormwater and Wastewater
- Copper Limits Outfall 002
