The post Friday regarding the Arkansas Pollution Control and Ecology Commission (“Commission”) consideration on C & H Hog Farms, Inc.’s issues contained an error (see link to previous post).
The Arkansas Pollution Control and Ecology Commission did uphold a Recommended Decision by Administrative Law Judge (“ALJ”) Charles Moulton regarding C & H Hog Farms, Inc.
The post, however, referred to the wrong Recommended Decision. The Commission upheld Order No. 1 in which the ALJ:
- Denies C & H’s Motion for Summary Judgment on its Request for Declaratory Order; and
- Finds that there are no genuine material facts in dispute and, based on the law grants Interveners’ Motion for Summary Judgment on C & H’s Request for Declaratory Order.
