Four environmental organizations have sent a March 23rd Notice of Intent to Sue (“Notice”) to the owners or operators of the Allegheny Ludlum Steel Mill (“facility”) in Allegheny, Pennsylvania for alleged Clean Air Act violations.
The four organizations are Environmental Integrity Project, Group Against Smog and Pollution, PennEnvironment, and Clean Air Council (collectively “EIP”).
The facility is described as a specialty steel products operation.
The Notice provides that a Clean Air Act citizen action was filed in federal court alleging that emissions from the facility’s two electric arc furnaces have violated and continue to violate a Minor Modification Installation Permit (issued by the Allegheny County Health Department).
The Notice alleges the facility’s electric arc furnaces have violated and continue to violate the permit’s pre-heat limits for sulfur oxides, nitrogen oxides, carbon monoxide and particulates. It is also alleged that each electric arc furnace has emitted sulfur oxides exceeding its limit of 6.97 tons.
