Clean Air Carolina (‘CAC”) filed a February 5th Petition for Contested Case Hearing (“Petition”) challenging the North Carolina Department of Environmental Quality (“NCDEQ”) issuance of an air permit to Align RNG, LLC (“Align”).
The Air Permit No. 10644R00 (“Air Permit”) addresses the construction and operation of a biogas processing facility (“Facility”) in Duplin County, North Carolina.
The Petition alleges that the NCDEQ Division of Air Quality:
. . . could not reasonably determine that the processing facility is not a “major source” under Title V of the federal Clean Air Act . . . that the facility will not contribute to a violation of the National Ambient Air Quality Standards. . . or that the Permit otherwise complies with the federal Clean Air Act and its federal implementing regulations.
The Petition is filed in the State of North Carolina Office of Administrative Hearings.
