House Bill 1654 was introduced by Representative Jett which addresses certain duties and powers of the Arkansas State Petroleum Products Division (“Division”).
The legislation describes itself as clarifying the law concerning the engine fuels authorized to be tested by the Division.
Arkansas Code § 4-108-205(b) amends certain authorities associated with testing engine fuels. Paragraph (ii) is added to (b) to provide:
. . . As used in subdivision (b) (2) (A) (i) of this section, “engine fuels” does not include aviation fuels.
The legislation also addresses incidences in which state authorities are denied access by the owner or agent or other persons leasing a place where engine fuels, petroleum products, or automotive lubricants are kept, transferred, offered, exposed for sale, or sold for the purpose of examination, inspection, taking of samples, and investigation. It indicates that the Director of the State Plant Board may obtain an administrative search warrant from a court of competent jurisdiction.
Additional related authorities also exempt “aviation fuel” from the scope of the term “engine fuels.”
The bill is sponsored by Representative Joe Jett (Success). The bill has been referred to the House State Agencies and Governmental Affairs Committee.
