The United States Environmental Protection Agency (“EPA”) Office of Inspector General (“OIG”) issued a Project Notification titled:
EPA Enforcement of Toxic Release Inventory (TRI) Late Reporters
The Project Notification was directed to Ms. Susan Bodine, Assistant Administrator, EPA Office of Enforcement and Compliance Assurance.
The project objective is stated to be to address whether EPA is taking enforcement actions against companies that delay required reporting of chemical release data to EPA’s TRI.
Section 313 of the Emergency Planning and Community-to-Know Act (“EPCRA”) created the Toxic Release Inventory (“TRI”) program. The EPCRA requirements mandate that all covered United States facilities that meet TRI reporting requirement criteria submit TRI data to EPA and the relevant state or tribe by July 1 of each year.
EPA has established an e-Disclosure system that allows facilities to self-report certain EPCRA violations and make corrections without being fined. The e-Disclosure portal can be accessed through ’s Central Data Exchange (“CDX”) (https://cdx.epa.gov/).
OIG states that the project will include EPA’s Office of Enforcement and Compliance Assurance. Further, it will involve the analysis of TRI reporting data from select EPA regions to be determined at a later date.
