The Alabama Department of Environmental Management (“ADEM”) and Clean Earth of Alabama, Inc. (“Clean Earth”) entered into a May 30 Consent Order (“CO”) addressing alleged violations of certain Alabama Hazardous Waste Management and Minimization Act regulations. See Consent Order No. 19-XXX-CHW.
The CO provides that Clean Earth operates a commercial hazardous waste treatment and storage facility under an Alabama Hazardous Waste Management and Minimization Act Hazardous Waste Facility Permit in Glencoe, Alabama.
The facility is described as a treatment and storage facility.
ADEM representative is stated to have conducted a compliance evaluation inspection of the Clean Earth facility on February 6, 2019. Alleged violations identified were stated to include:
- storage of hazardous waste in unpermitted area
- failure to maintain an intact impervious coating on a containment system
Clean Earth neither admits nor denies ADEM’s contentions.
A civil penalty of $10,000 is assessed.
