The Alabama Department of Environmental Management (“ADEM”) and Plasman Corp LLC (“PLASMAN”) entered in a May 7th Consent Order addressing alleged violations of certain hazardous waste regulations found in ADEM-Admin. Code Div. 14. See Consent Order No. 20-XXX-CHW.
The CO provides that Plasman operates an exterior plastic automotive parts manufacturing and packaging facility (“Facility”) in Fort Payne, Alabama.
The Facility is stated to be a large quantity generator as that term is defined in ADEM Admin. Code Div. 14.
ADEM personnel are stated to have conducted a compliance evaluation inspection (“CEI”) on November 20, 2019, at the Facility. The CEI allegedly determined:
- Plasman failed to mark some pieces of equipment connected to the three hazardous waste storage tanks associated with the Painting Area and Kitchen;
- Plasman failed to conduct daily tank inspections on weekends and holidays;
- Plasman failed to keep closed one 55-gallon satellite accumulation drum located at the Manufacturing Area even when not adding, removing, or consolidating waste. Plasman neither admits nor denies ADEM’s contentions.
A civil penalty of $5,400 is assessed.
