The United States Environmental Protection Agency (“EPA”) and Stony Brook Pathologists (“SBP”) entered into a March 31st Expedited Settlement Agreement and Final Order (“ESA”) addressing an alleged violation of the New York hazardous waste regulations. See Docket No. RCRA-02-2022-7206.
Stony Brook Pathologists is stated to be the owner of the Stony Brook Pathologists Laboratory facility (“Facility”) in Stony Brook, New York.
EPA is stated to have conducted a review of e-manifest data of hazardous waste shipments from this Facility. Further, the ESA states that EPA had discussions with SBP regarding its findings.
EPA is stated to have determined that SBP failed to have an EPA identification number prior to transporting or offering for transport hazardous waste from its Facility. It is further provided that during the years 2018-2021 SBP shipped hazardous waste from its Facility using hazardous waste manifests without having received an EPA identification number in violation of Title 6 N.Y.C.R.R. Section 372.2(a)(3).
SBP neither admits nor denies the allegations contained in the ESA.
The ESA assesses a civil penalty of $1,250.
