The Occupational Safety and Health Administration (“OSHA”) issued a February 4th news release stating it was proposing to assess civil penalties to Cleveland Brothers Inc. (“CBI”) for alleged violations at the company’s Camp Hill, Pennsylvania shop.
The CBI shop is stated to provide hydraulic service and repair, machining and chromium services.
OSHA is stated to have initiated an investigation of hexavalent chromium fumes. Hexavalent chromium is one of the valence states of the element chromium. A source of worker exposure can occur during hot work such as welding on stainless steel and other alloy steels containing chromium metal.
OSHA proposes to cite CBI for the following classes of violations:
- One willful
- 18 serious
- Two other-than-serious
The violations allegedly include failure to train employees on the hazards of hexavalent chromium and maintenance of a respiratory protection program.
A civil penalty of $280,874 is proposed to be assessed.
The company has 15 days from receipt of the citations and penalties to comply, request an informal conference with OSHA’s area director, or contest the findings before the independent Occupational Safety and Health Review Commission.
