The United States Fish and Wildlife Service (“Service”) and Center for Biological Diversity (“CBD”) entered into a January 16th Stipulated Settlement Agreement (“Agreement”) imposing deadlines for required listing decisions for 76 species pursuant to the Endangered Species Act (“ESA”).
CBD had filed a Complaint in 2020 in the United States District Court for the District of Columbia against the Service to compel it to complete listing and critical habitat by dates certain for various species.
The Agreement requires that the Service submit 12-month findings for the 76 referenced species pursuant to 16 U.S.C. § 1533(b)(3)(B) to the Federal Register by the end of the fiscal year 2029. A schedule for sequentially addressing a certain number of the species to meet the previously referenced requirement is found in the Agreement.
The four species whose habitat includes the State of Arkansas are:
- Golden-winged warbler - Vermivora chrysoptera.
- Longnose darter - Percina nasuta.
- Ozark shiner - Notropis ozarcanus.
- Peppered shiner - Notropis perpallidus.
