A number of environmental organizations filed a Petition for Review (“Petition”) in the United States Court of Appeals for the Fourth Circuit challenging the West Virginia Department of Environmental Protection’s (“DEP”) issuance of a Water Quality Certification under Section 401 of the Clean Water Act for the Mountain Valley Pipeline.
The environmental organizations filing petitions include:
- Sierra Club
- West Virginia Rivers Coalition
- Indian Creek Watershed Association
- Appalachian Voices
- Chesapeake Climate Action Network
The environmental organizations state they are challenging an Order entered by DEP on March 23rd and finalized upon denial of requests for hearing on May 10th.
The environmental organizations have described the pipeline as one which would transport fracked gas across the states of West Virginia.
