The United States Environmental Protection Agency (“EPA”) and Town of Rotterdam, New York (“Rotterdam”) entered into a July 7th Consent Agreement and Final Order (“CA”) addressing alleged violations of the Clean Water Act. See Docket No. CWA-02-2016-3309.
The CA alleges that Rotterdam is liable for violations of the Clean Water Act in the operation of its Municipal Separate Storm Sewer System (“MS4”).
The MS4 is stated to be located in Schenectady County, New York.
The CA does not further identify or describe the alleged MS4 violations.
The CA assesses a civil penalty of $15,000. In addition, Rotterdam agrees to perform a Supplemental Environmental Project (“SEP”).
The SEP is described as the creation of a:
. . . porous parking area and rain garden project. The project is described as including an educational component and use of Next Generation compliance tools.
The total expenditure for the SEP must not be less than $187,233.
