Three environmental organizations sent Jasper Pellets, LLC (“Jasper”) a September 22nd Notice of Violations and Intent to Sue (“NOI”) alleging violations of the Clean Air Act by its Ridgeline, South Carolina, wood pellet manufacturing facility (“Facility”).
The three environmental organizations include:
- Environmental Integrity Project
- Southern Environmental Law Center
- South Carolina Coastal Conservation League
(collectively, “SELC”)
The NOI describes the Facility as processing raw wood materials into compressed pellets that are utilized to generate electricity in power plants. The Facility is stated to emit various air pollutants.
The Facility is stated to currently hold an air permit. However, SELC states that it does not hold, nor has it ever held, a federal operating permit.
The NOI alleges that Jasper has been illegally operating the Facility without having applied for or having obtained a required permit under Title V of the Clean Air Act. It is also alleged that Jasper violated the Clean Air Act by constructing new manufacturing equipment as part of an expansion of production capabilities prior to receiving a permit authorizing such construction.
The NOI states that a federal action will be filed under Section 304(a) of the Clean Air Act in the absence of a negotiated settlement of the alleged violations.
