Bottom Line Inc. (“BLI”) filed a February 3rd Request for Adjudicatory Hearing and Issuance of a Stay (“Request”) challenging a Clean Water Act National Pollution Discharge Elimination (“NPDES”) permit renewal for Two Rivers Harbor Property Owners Association (“Two Rivers”). See Docket No. 21-001-P.
BLI references an NPDES permit modification for a wastewater treatment facility (“Facility”) in Pulaski County, Arkansas.
The Facility is stated to be owned by BLI. BLI argues that it understands that the Facility is a “new treatment plant” (or at least a substantial modification). It further argues that if that is the case approval from BLI (i.e., the property owner) would be required. BLI states it has not provided such approval.
BLI challenges previous maintenance of the Facility and states it may not approve the new and/or substantially modified treatment plant. This is based on its assertion that it has not received any information from Two Rivers regarding the proposed Facility.
