The United States Army Corps of Engineers (Vicksburg District) (“Corps”) issued a September 7th Public Notice referencing a Clean Water Act Section 404 application for the placement of dredged and fill material in waters of the United States by the Wiggins Family Real Estate Holdings, LLC (“Wiggins”). See MVK-2021-869.
Wiggins’ application indicates that the work will involve construction of a single-family home residential development.
The application is stated to indicate that a new residential subdivision is proposed to be constructed in Bryant, Arkansas. Further, the Public Notice states that the application indicates that the development:
. . . would provide new single-family residences in a fast-growing area of Saline County, Arkansas.
The proposed development is stated to encompass approximately 64 acres of which most is maintained as pastureland.
Proposed impacts to waters of the United States are stated to include:
- Levelling of the land
- Installing utilities
- Addressing erosion control
- Providing drainage
The Public Notice indicates that the regulated impacts to jurisdictional waters and wetlands are proposed as follows:
- Fill 2.78 acres of forested wetlands (0.49 impounded)
- Fill 0.47 acres of emergent wetlands
- Fill 161 linear feet of an intermittent stream (rerouted for final channel length of 699LF
- Fill 1001 linear feet of ephemeral streams
- Impound 98 linear feet of ephemeral streams
The applicant is stated to be proposing to purchase the required compensatory mitigation credits from a Corps Vicksburg District approved mitigation bank.
