The United States Occupational Safety and Health Administration (“OSHA”) issued a news release stating it issued citations to County Concrete Corp. (“CCC”) for alleged violations related to silica.
OSHA states that CCC is a concrete manufacturer located in East Orange, New Jersey.
The agency states it conducted an inspection on July 19, 2016 and identified repeated violations.
OSHA alleges that CCC failed to conduct annual tests to ensure that respirators fit employees properly while they were cleaning concrete mixers. As a result, failure-to-abate violations were issued for the company’s alleged failure to:
- Develop and implement a written respiratory protection program for employees required to wear respirators during concrete mixer cleaning operations.
- Provide medical evaluations for employees required to wear respirators to determine their ability to use them without their health being compromised.
OSHA has proposed penalties of $88,544.
CCC has 15 business days from receipt of its citations and proposed penalties to comply, request a conference with OSHA’s Area Director or contest the findings before the independent Occupational Safety and Health Review Commission.
