The United States Environmental Protection Agency (“EPA”) and White Palace Energy (“WPE”) entered into an August 10th Expedited Settlement Agreement (“ESA”) addressing alleged violations of the Clean Water Act Spill Prevention,
Control and Countermeasure (“SPCC”) regulations.
WPE is stated to own or operate a facility (“Barnsdall”) located in Osage County, Oklahoma.
The ESA provides that an EPA representative conducted an inspection to determine compliance with the SPCC regulations promulgated at 40 CFR Part 112. The inspection allegedly determined that WPE violated certain SPCC regulations.
The alleged SPCC violations included:
- Qualified facility requirements not maintained for three years - 112.7(e)
- Training records not maintained for three years - 112.7(f)
- Excessive vegetation affecting the integrity of the containment - 112.9(c)(2)
- Walls of containment system are slightly eroded or at low areas -112.9(c)(2)
The ESA assesses a civil penalty of 600.00.
