The United States Environmental Protection Agency (“EPA”) and Northern Virginia Electric Cooperative (“NVEC”) entered into a May 21st Consent Agreement (“CA”) addressing alleged violations of the Federal Underground Storage Tank (“UST”) Regulations. See Docket No. RCRA-03-2024-0097.
The CA provides that NVEC is the owner and/or operator of USTs at its Manassas, Virginia facility (“Facility”).
EPA is stated to have conducted a compliance evaluation inspection at the Facility on March 29, 2023. The Facility is stated to utilized 3 USTs. Such USTs are stated to be constructed of double-walled, fiberglass, reinforced plastic and utilize pressurized double-walled fiberglass reinforced plastic piping that routinely contained regulated substance conveyed using a pressurized piping system.
The CA alleges the following violations:
- Failure to test the automatic tank gauge system annually for proper operation.
- Failure to equip UST systems with adequate overfill equipment.
A civil penalty of $26,118.00 is assessed.
