The United States Environmental Protection Agency (“EPA”) and Sunoco Retail LLC (“SR”) entered into a July 2nd Expedited Settlement Agreement (“ESA”) addressing alleged violations of the federal underground storage tank (“UST”) regulations.
The ESA provides that SR is the owner and/or operator of USTs at the following locations:
- Monroe Mobil – Monroe , New York
- Wasco Service Station – Port Chester
- Walden Mobil, Walden – New York
- Wilson Field Mobil – Middletown, New York
EPA is stated to have determined that SR failed to comply with certain requirements of Subtitle I of the Resource Conservation and Recovery Act and its implementing regulations at 40 C.F.R. Part 280. Such alleged violations include:
- Failure to maintain
- Failure to test
- Failure to properly monitor
- Failure to annually test
SR is stated to neither admit nor deny the factual determinations of the ESA.
A civil penalty of $8,710 is assessed.
