The United States Environmental Protection Agency (“EPA”) and Heartland Park (“HP”) entered into a June 25th Expedited Settlement Agreement (“ESA”) addressing alleged violations of the federal underground storage tank (“UST”) regulations. See Docket No. RCRA-07-2018-0230.
The ESA provides that HP is the operator of an UST in Topeka, Kansas.
The ESA references an inspection of the Topeka, Kansas, UST. Alleged violations identified include:
- Failure to provide adequate line leak detector system for underground piping (mechanical line leak detector removal for STP)
- Failure to provide adequate line leak detector system for underground piping (annual junction test if out of date, last date took place on 10/31/16
The ESA references a proposed penalty of $508.00.
