The Mississippi Commission on Environment Quality (“MCEQ”) and Midsouth Green LLC (“Midsouth”) entered into an Agreed Order (“AO”) addressing an alleged violation of regulations related to stormwater control. See Order No. 7063 20.
The AO references Midsouth’s “Green Mine” located in Lafayette County, Mississippi.
MCEQ is stated to have notified Midsouth of a violation at the Green Mine on November 20, 2019. The AO alleges that Midsouth failed to obtain coverage under the Mining Storm Water General Permit (“Permit”).
The alleged failure to obtain a Permit is stated to be a:
Violation of Mississippi Air and Water Pollution Control Law (Sections 49-17-1, et seq., Mississippi Code of 1972), and Federal Regulation, 40 CFR 122.26(b)(14)(iii), . . .
The AO states that Midsouth has since applied for and received coverage under the Permit.
The AO assesses a civil penalty of $2,800.
