The Mississippi Commission on Environmental Quality (“MCEQ”) and JWM Development, LLC (“JWM”) entered into a September 27th Agreed Order (“AO”) addressing alleged violations of a Clean Water Act Storm Water Permit. See Order No. 7216 22.
The AO provides that JWM is undertaking a subdivision development (“Highland Subdivision Phase 12”) in Lafayette County, Mississippi.
MCEQ is stated to have notified JWM by letter dated April 11, 2022, of the following alleged violations:
A. Violation of ACT 6 Condition S-1 (1): Failure to implement the SWPPP.
B. Violation of ACT 6 Condition S-3 (11): Failure to maintain erosion controls.
C. Violation of ACT 7 Condition L-1 (1): Failure to meet non-numeric limitation requirements.
D. Violation of ACT 6 Condition S-5 (1 ): Failure to maintain weekly inspection reports.
JWM is stated to have provided documentation dated April 25th, May 6th, and August 9th outlining corrective actions taken to address the above-referenced alleged violations to return to compliance with its Large Construction Stormwater General Permit.
The AO assesses a civil penalty of $14,000.
