The Mississippi Commission on Environmental Quality (“MCEQ”) and J and J Cars, LLC (“J and J”) entered into an October 18th Agreed Order (“AO”) addressing an alleged violation of the Mississippi Administrative Code related to discharge into waters of the State. See Order no. 7156 21.
The AO provides that J and J operates a salvage yard in Lamar, Mississippi.
J and J is stated to have been contacted by MCEQ and notified of certain violations discovered during an investigation on December 17, 2020. The alleged violations include:
- Violation of MS Code Admin 49-17-29 (2b)(addressing disposal of waste into waters of the State unless subject to an exemption)
- Violation of 11 Miss. Admin, Code Pt. 6, R. 1.1.1B (2)(b)(1) and 40 CFR 122.26(a)(ii) (addressing discharges of waste into surface waters without a Mississippi Industrial Storm Water General NPDES Permit)
The AO assesses a civil penalty of $15,750.
