The Mississippi Commission on Environmental Quality (“Commission”) and Complete Oil Field Disposal, LLC. (“COD”) entered into an August 27th Agreed Order (“AO”) addressing failure to obtain a Stormwater Construction Permit. See Order No. 7348 24.
The AO provides that COD was contacted by the Commission on February 12th regarding its construction project located in Natchez, Mississippi.
COD is stated to have conducted land disturbing activities without coverage under Mississippi’s Large Construction General Permit for Land Disturbing Activities of Five or More Acres. This constitutes a violation of Miss. Code Ann. § 49-17-29(2)(b).
A letter dated July 19th is stated to have provided color photographs showing that the referenced site had been fully stabilized. Further, COD is stated to have asserted that future land disturbing activities at the site would not occur before it submits a Large Construction Notice of Intent and Stormwater Pollution Prevention Plan to the Commission, and it has obtain coverage under the Large Construction General Permit for Land Disturbing Activities of Five or More Acres.
A civil penalty of $4,200.00 is assessed.
