The Oregon Department of Environmental Quality (“ODEQ”) issued a January 16th Notice of Civil Penalty Assessment and Order (“Notice”) to Purcell Tire NW, Inc. (“Purcell”). See Case No. WQ/SW-NWR-2023-575.
The Notice addresses Purcell’s facility in Portland, Oregon.
The Notice states that the facility was assigned coverage under National Pollutant Discharge Elimination System General Permit No. 1200-Z. Such Permit authorizes Purcell to construct, install, modify, or operate stormwater treatment or control facilities, and to discharge stormwater and non-stormwater discharges authorized by the Permit to surface waters of the state.
The facility is stated to discharge stormwater to Osburn Creek.
The Notice alleges that Purcell violated its General Permit by failing to monitor its stormwater for benchmark and impaired pollutants. Specifically, Purcell is stated to have conducted only one instead of the two rounds of monitoring at its facility.
The Notice proposes a civil penalty of $5,916.
Purcell is provided the right to request a contested case hearing.
