The Washington Department of Ecology (“WDE”) issued a Notice of Penalty (“Notice”) to Seattle Iron & Metals Corp. (SIMC”) alleging violations of the Clean Water Act related to stormwater discharges.
SIMC is a scrap metal facility located in Seattle, Washington.
The Notice alleges violations of:
- Chapter 173-220 Washington Administrative Code
- National Pollutant Discharge Elimination System Permit No. WA0031968
SIMC is stated to recover metal from cars and other machinery. The company is stated to operate a treatment system to remove pollutants from stormwater that drains from its facility into a waterbody.
The Notice alleges violations of effluent limits involving:
- copper
- zinc
- lead
- petroleum compounds
- ammonia
- fine particles
Stormwater also is alleged to have been allowed to bypass the facility’s treatment system.
The facility is stated to be in the design phase for improvements to the stormwater system to address the alleged violations.
The Notice assesses a $64,000 civil penalty.
