The United States Environmental Protection Agency (“EPA”) published “correcting amendments” in the Federal Register on March 23rd. See 86 Fed. Reg. 15421.
The correcting amendments are to a final rule published on October 7th providing corrections and updating regulations for source testing of air emissions. See 85 Fed. Reg. 63395. See also a post describing the final rule here.
The October 7th corrections and updating regulations were promulgated as part of the Clean Air Act. Further, they apply to industries subject to the provisions of 40 C.F.R. Parts 51, 60, 61, and 63. They are part of an ongoing process EPA undertakes to catalog errors, corrections, and improved alternatives to test methods, performance specifications and associated regulations in the previously reference Code of Federal Regulations.
The March 23rd correcting amendments does not change any final action taken by EPA on October 7th. Instead, EPA states that the action is correcting amendatory instructions for Methods 4 and 5.
