The Mississippi Commission on Environmental Quality (“Commission”) and City of Wesson, Mississippi (“Wesson”) entered into a July 12th Agreed Order (“AO”) addressing alleged violations of a Clean Water Act National Pollution Discharge Elimination System (“NPDES”) permit. See Order No. 6768 17.
The AO states that Wesson owns and operates a Public Owned Treatment Works (“POTW”) located in Copiah County, Mississippi.
The POTW is operated pursuant to NPDES Permit No. MS0023779.
The AO alleges certain violations of the NPDES Permit which include:
- Effluent total ammonia nitrogen limitations were exceeded during the first and second quarters of 2016
- Fecal coliform, total suspended solids, suspended solids percent removal and BOD 5-day limitations were exceeded during the first and second quarters of 2016
Wesson is stated to have submitted documentation (dated May 17, 2017) reporting corrective actions taken to address the violations. Such documentation was also stated to have demonstrated compliance with the total ammonia nitrogen, fecal coliform, BOD 5-day and total suspended solids effluent limitations.
The AO assesses a civil penalty of $2,812.50.
