The Mississippi Commission on Environmental Quality (“MCEQ”) and Consolidated Catfish Companies, LLC (“CCC”) entered into a December 18th Agreed Order addressing an alleged violation of a Clean Water Act National Pollutant Discharge Elimination System (“NPDES”) permit. See Order No. 7298-23.
CCC owns and operates a farm-raised catfish processing operation in Isola, Mississippi.
The operation includes a wastewater treatment facility (“Facility”). Such Facility is permitted to discharge treated effluent from its catfish processing operation pursuant to the NPDES permit.
MCEQ is stated to have notified CCC by letters dated April 6, 2023, and December 5, 2023, of alleged violations of the discharge limitations required by the NPDES permit.
Alleged violations provided by the AO are stated to involve:
- Total Ammonia Nitrogen
- E coli Limitation
- Total Suspended Solids
Further, the AO states that CCC reported NODI = P (Laboratory Error or Invalid Test) for Oil & Grease
A civil penalty of $24,000 is assessed.
